How A New York Traffic Ticket (including a New York Speeding Ticket) Effects Auto Insurance Rates

This Article addresses the effect on your automobile insurance rates from being convicted of a New York traffic ticket including speeding.

As a New York Traffic Lawyer, I often am asked will a conviction to a NY traffic ticket effect my insurance rates. This question is often posed because insurance rates are one of the primarily reasons why someone would want to fight a moving violation ticket. The short answer is sometimes "yes" and sometimes "no".

Under Insurance Law Section 2335, insurance companies in New York State may raise a motorist's insurance rates for a number of reasons. The ones involving the issuance of a traffic ticket are set forth below:

How A New York Traffic Ticket (including a New York Speeding Ticket) Effects Auto Insurance Rates

Motorist is convicted of driving sixteen (16) miles per hour (or more) over the limit Motorist has been convicted of speeding and/or reckless driving on 3 or more occasions Motorist has been convicted of speeding or reckless driving where injury or death results Motorist is convicted of driving while intoxicated or impaired (alcohol or drugs) Motorist is convicted of leaving the scene of an accident without reporting it Motorist is convicted or 2 or more moving violations

So what does this mean?

For a motorist with a clean record (i.e., no points, no accidents), a conviction to most "small" moving violations will NOT result in your insurance rates being raised. Examples of such offenses are disobey a red light, running a stop sign, failure to signal, speeding fifteen (15) miles per hour (or less) above the limit and improper turns. The second conviction, however, for a "small" offense can be used against you to hike your rates.

The next question commonly asked is how long will such a blemish on my driver record be held against me. The answer is 36 months from the date of conviction.

The lesson behind Section 2335 is that it does not take much for an insurance company to have a basis to raise your rates. One "big" ticket or two "small" tickets is enough. Therefore, it is generally worthwhile fighting any New York moving violation ticket to try and reduce or eliminate points.

USPS Mailbox Requirements

The United States Postal Service has specific requirements for all residential curbside mail boxes. The USPS Domestic Mail Manual sets forth regulations and rules concerning residential curbside mailboxes. The manual describes the standards for letterboxes and other mail receptacles for the deposit or receipt of mail.

Residential Mailboxes
A residential mailbox is any curbside or wall-mounted receptacle which is used for the purpose of receiving material in which postage is paid.

Who Can Use A Mailbox
Only authorized letter carriers may place mail or packages into the mail receptacle. No part of the mail receptacle may be used to deliver anything that does not contain postage. This includes items attached to the box, hung from the box or inserted into the mail box. Any mailable material not displaying postage and found in the mailbox is subject to the same amount of postage as if it were carried by a mail carrier.

USPS Mailbox Requirements

Exclusions from USPS Rules
Door slots and other non-lockable bins used with apartment mailboxes are subject to the same regulations as a curbside mailbox. Just keep in mind that a mail slot should be large enough to accommodate the type of mail the homeowner receives. If the mail slot is not large enough, then the mail carrier will cease delivering mail to the residence.

Curbside Mailboxes
All homeowners must keep the area around their mailboxes clear of anything than will obstruct the safe delivery of mail. If the United States Postal Service employee cannot safely reach in and deliver the mail, the postmaster may withdraw delivery to that mailbox.

Any curbside mailbox which is to be installed at the edge of the roadway or curbside of the street and allows it to be served by a mail carrier from a vehicle on any city route, rural route or highway must be approved by the United States Postal Service.

Every curbside mailbox should display the homeowner's name and address assigned by the local authorities on the flag side of the mailbox. The numbers and letters must be at least one inch high and in a contrasting color in neat, legible letters. If the boxes are grouped and the address cannot be placed on the flag side of the mailbox, then the house number should be inscribed on the door. No advertising of any kind can be placed on the mailbox or the mailbox post.

Mailbox Sizes
There are regulations regarding curbside mailboxes. A curbside mailbox can be one of three size for residential mail: small T1 (C1) size is approximately 5 inches wide by 6 inches tall and 18 ½ inches long, Medium T2 (C2) size is approximately 6 inches wide by 7 inches tall by 19 inches long, and the Large T3 (C3) size is approximately 8 inches wide by 11 ½ inches tall by 22 ½ inches long. The "T" stands for Traditional and the "C" stands for Contemporary. The dimensions reflect the minimum interior size.

Lockable Mailboxes
A locking curbside mail box will help to deter most thieves from stealing your mail. Many residential mailboxes are available with a built-in locking mechanism. If your mailbox is not equipped with a lock, you can purchase one from several online sources. Locks are essential for deterring thieves and are extremely important when the homeowner is away for several days and unable to retrieve the mail. Also note that the U.S. Postal Service will not open locked boxes nor will they accept a key for that purpose. Locks can be installed on both post and wall mounted mailboxes. When installing a lock on an existing mailbox, make sure your mailbox is strong enough to withstand an attack. Lockable mailboxes should be large enough so that if the homeowner is away for several days, it can accommodate the overflow of mail.

Novelty Mailboxes
Novelty mailboxes are mailboxes that have been dressed up or decorated in some fashion. The same rules and regulations apply to novelty mailboxes as do pre-approved and custom-built mailboxes.

Where to Place A Residential Curbside Mailbox
All curbside mailboxes must be placed in a safe and convenient place. The box must be on the right-hand side of the road in the direction of travel of the mail carrier's normal route. The box should not be placed where it places the mail carrier in a dangerous situation or drive on the incorrect side of the road or violate any traffic laws.

The curbside mailbox post should be positioned 6-8 inches from the curb and approximately 42-46 inches high measured from the lawn to the top of the installed curbside mailbox, not the top of the post. If the post has a vertical arm, the arm should not extend any closer than 6 inches from the curb. When installing your new set, make sure your set complies with these regulations.

Wall Mount Mailboxes
The USPS does not have rules or regulations for wall mount mailboxes, however, you should notify your local mail carrier before installation to ensure proper placement of the mailbox and check for any local codes or regulations governing placement of the mailbox. The product should operate easily and nothing should obstruct the opening and closing of the lid. Also check with your home owners association to see if they have any rules or requirements which you need to comply with.

Building Your Own Mailbox
All custom built curbside mailboxes must meet the same standards as approved mailboxes. Custom built mailboxes should have a flag on the outside, strength, durability and quality should be comparable to approved mailboxes.

Be cautious when building your own mailbox and post. Approximately 100 motorists are killed yearly in collisions with curbside mailboxes. Some posts are mounted in concrete or constructed of indestructible materials. In a collision, a motor vehicle can be severely damaged and its occupants injured or killed.

Mailbox Post
Mailbox posts should be neat and made of material that can adequately support the mailbox. The mailbox post may not represent effigies or caricatures that can disparage or ridicule anyone. The mailbox can be attached to a fixed or movable arm.

Free Arrest Warrant Search - Have I Got Active Arrest Warrants?

Do you think that you might have an arrest warrant?

Are you looking for a free arrest warrant search because you think that there might be an active arrest warrant issued for you? Do you think that you have done something wrong or are you worried that you might have a warrant through no fault of your own?

If you know that you've committed a crime then you know that there is a good chance that a warrant has been issued on you. If this is the case then your best course of action is to get a lawyer and hand yourself in. If you don't then you are going to have to live the life of an outlaw.

Free Arrest Warrant Search - Have I Got Active Arrest Warrants?

You might have a warrant for silly reasons, like forgetting to turn up in court or failing to pay a fine for something. If this happens then you most likely have collected a Bench Warrant. It's the same as an arrest warrant as far as you are concerned, it will get you arrested just the same.

You can end up with a warrant even when you haven't done anything wrong. The police only have to think that you are involved in a crime and they can get a warrant for you. Someone might even be impersonating you when they committed the crime and the police have details of your identity instead of the criminals.

Do nothing and get a free arrest warrant search

You could just ignore the fact that you might have an arrest warrant. Sooner or later you will get stopped for some minor traffic offence or routine inspection. When this happens the police will reward you by doing a free warrant search for you. If they find that you have a warrant they will most likely arrest you right there.

You don't have to wait to be stopped by the police. You could just go to them and ask if you have any warrants. They will do a warrant search for free but again, they are likely to arrest you if the search finds an active warrant.

Free warrant searches at the courthouse

Do you know which county your warrants were issued in? You should know this if you forgot to turn up in court for instance. If so then you can go to the county courthouse and ask. This should be free in most cases and it won't get you arrested unless the warrant is for something very serious. You have to go to the right courthouse for this to work though. They will probably not be able to search other county records for you.

If you aren't sure which county the warrant is in then you could try state records. Most counties feed their records up to the state but the process can be slow and sometimes not very reliable. To be on the safe side you should check warrant records at the county and state level.

Search for free arrest warrants in public records

Arrest warrants are public records and there are some web sites that are making it their business to collect all publicly available records from across the nation into a huge database. They then organize the data and make it all available to you for easy searching nationwide.

These public records web sites are very effective at finding information about people fast and it's not just arrest warrants either. You can search for criminal records and all sorts of background information. You can also do the search on anyone you want to, not just yourself.

Depending on which public records web site you use, you can either pay a small fee for each search that you do or, you can pay a small monthly subscription and do as many free arrest warrant searches as you want to. You can search nationwide and background check practically anyone.

What's the Difference Between DS3 and T3 Bandwidth?

Don't be confused about the difference between DS3 and T3 circuits. These terms are really synonymous. Instead you should focus on what they can do for you...and the best scenarios for application.

Digital Signal (DS) is a system of classifying digital circuits according to the rate and format of the signal (DS) and the equipment providing the signals (T). DS and T designations have come to be used synonymously so that DS1 implies T1, and DS3 implies T3.

A DS3 line (also known as a T-3) is an ultra high-speed connection capable of transmitting data at rates up to 45 Mbps. A DS3 line is equal to approximately 672 regular voice-grade telephone lines, which is fast enough to transmit full-motion, real-time video, and very large databases over a busy network. A DS3 line is typically installed as a major networking artery for large corporations and universities with high-volume network traffic. Other example applications include large call centers, enterprise wide VoIP and IP PBX systems, Internet service providers, research labs, video conference centers and software development companies. A DS3 is the second fastest, non optical connection offered in North America. A DS3 line is comprised of 28 T1 lines, each operating at total signaling rate of 1.544 Mbps.

What's the Difference Between DS3 and T3 Bandwidth?

DS3 circuits provide businesses and Internet Service Providers (ISPs) with up to 45 Mb/s of dedicated Internet connectivity. This is an ideal solution for users who have outgrown their T1 connections and are in search of unlimited, high-capacity access. A DS3 line actually consists of 672 individual channels, each of which supports 64 Kb/s. DS3 lines are extremely high bandwidth connections into a carrier's backbone. They typically include SLAs (Service Level Agreements) that guarantee uptime and performance.

The DS3 signal itself is composed of 28 DS1 signals and is constructed using a two-step multiplexing process. First, the 28 DS1 signals are multiplexed into seven DS2 signals. Second, the seven DS2 signals are multiplexed into one DS3 signal. Each multiplexing step uses bit stuffing to handle the different input frequencies. Overhead bits provide alignment, error checking, in-band communications, and bit stuffing control information.

Line rate: 44,736,000 b/s
Signals: 7 DS2 signals = 28 DS1 signals

Overhead bits:
56 bits total/frame
F-bits (framing) 28 bits/
M-bits (multiframing) 3 bits/
C-bits (stuffing) 21 bits
X-bits (message) 2 bits/
P-bits (parity) 2 bits/
Data bits between overhead bits 84

A DS3 connection is comprised up of two monthly charges: the local loop and the port charge. The local loop charge is the cost of the circuit provided by the Local Exchange Carrier (LEC) that allows DS3 access into the carrier's network. The loop charge is based on the distance from the customer's location to the edge of the carrier's network; the farther the customer is from the network, the more the loop will cost. Nearly every carrier prices loops differently so it is in your best interest to price DS3 service with several providers to ensure that you get the best deal.

DS Internet Access is the ideal solution for businesses that require high-bandwidth access at a reduced price. Whether you host high-traffic Web sites, support Web hosting or need high-capacity bandwidth on an as-needed basis, there's a level of DS3 service (Full or fractional) that will meet your needs. Fractional to full DS3 or T3 circuits run from speeds of 3 Mbps up to 45 Mbps.

For customers that require more bandwidth than a T1 line can provide but do not yet require the capacity of a full DS3 line, a fractional DS3 connection is the ideal solution. A fractional DS3 is similar to a full DS(T)3, only with some of the channels turned off. This reduces the total monthly cost and provides additional capacity that can be turned up in a matter of days. Unfortunately, the DS3 (T) loop is still required for this service.

If a full DS3 line is more bandwidth that you really need, it is also possible to get Fractional DS3, which gives you a portion of full DS3 bandwidth at a lower cost. Of course, DS3 is also available in multiples to increase bandwidth, similar to bonded T1 service.

DS3 service can be deployed for a wide verity of applications. The most common uses are DS3 point-to-point, DS3 internet, DS3 frame relay, DS3 voice and DS3 VPN. The pricing for these connections varies widely depending on the carrier, location of service and the application for which the connection is being used. Visit DS3 Bandwidth Solutions to obtain current "real time" rate quotes for your location.

16 Ways to Drive Traffic to Your Blog

You've got your blog set up and you've started posting pithy, useful information that your niche market would benefit from and enjoy. Days go by, you keep publishing, but no one comments and your traffic stats are barely registering. What do you do?

Like any website you own, you must do some blog promotion to start driving traffic to your site. Here are 16 steps, in no particular order of importance, that you can start doing now to get traffic moving to your blog.

1. Set up an email subscription form on your blog and invite everyone in your network to subscribe: family, friends, colleagues, clients, associates.

16 Ways to Drive Traffic to Your Blog

2. Set up a feed on MyYahoo.com so your site gets regularly spidered by the Yahoo search engine.

3. Read and comment on other blogs that are in your target niche. Don't write things like "nice blog" or "great post." Write intelligent, useful comments with a link to your blog.

4. Use Ping-0-matic to ping blog directories. Do this every time you publish.

5. Submit your blog to traditional search engines.

6. Submit your blog to blog directories.

Tip: Create a form to track your submissions; this can take several hours when you first start so schedule an hour a day for submitting or hire a VA to do it for you.

7. Add a link to your blog in your email signature file.

8. Put a link to your blog on every page of your website.

9. If you publish a newsletter, make sure you have a link to your blog in every issue.

10. Include a link to your blog as a standard part of all outgoing correspondence such as autoresponder sequences, sales letters, reports, white papers, etc.

11. Print your blog URL on your business cards, brochures and flyers.

12. Make sure you have an RSS feed URL that people can subscribe to. The acronym RSS means Rich Site Summary, or some may consider its meaning as Really Simple Syndication. It is a document type that lists updates of websites or blogs available for syndication. These RSS documents (also known as 'feeds') may be read using aggregators (news readers). RSS feeds may show headlines only or both headlines and summaries.

13. Post often to keep attracting your subscribers to come back and refer you to others in their networks; include links to other blogs, articles and websites in your posts

14. Use Trackback links when you quote or refer to other blog posts. What is TrackBack? Essentially what this does is send a message from one server to another server letting it know you have posted a reference to their post. The beauty is that a link to your blog is now included on their site.

15. Write articles to post around the web in article directories. Include a link to your blog in the author info box (See example in our signature below).

16. Make a commitment to blog everyday. 10 minutes a day can help increase your traffic as new content attracts search engine spiders. Put it on your calendar as a task every day at the same time.

Tip: Use a hit counter to track your visitor stats: how many unique visitors, how many page views, average length of visit.

The Common Causes of Road Traffic Accidents

In this article we are going to look at the most common causes of road traffic accidents that are in turn leading to accident compensation claims being made.

Intoxication

Many accidents are caused by drivers who are intoxicated from alcohol or drugs.

The Common Causes of Road Traffic Accidents

Bad Weather

One of the biggest causes of road traffic accidents is bad weather conditions. The weather can cause bad visibility or cause bad traction on the road surface which can in turn lead to vehicles colliding with each other or objects such as walls. Other unexpected weather conditions such as flash flooding and black ice can lead to accidents as it is to late to detect it until it has affected you.

Driver Error

Probably the largest cause of road traffic accidents currently is driver error. These are range from following cars too closely, falling asleep at the wheel, driving too fast, unsafe overtaking and many other careless and unnecessary mistakes.

Distractions

This is linked to driver error but is more about the driver being distracted by something outside the car or inside the car. Many accidents are caused by drivers actually being distracted by another accident happening on the road. But even things such as changing cds, looking at your mobile phone or checking out your make up in the mirror can all cause accidents. Basically anything that's makes you take your eyes off the road can create disastrous situations on the road.

Road Design

Sometimes accidents are caused by bad road design. This is when a part of the road or traffic control has been poorly placed or designed and can lead to increased accidents in the area. This could be anything from poorly placed signs blocking your view of incoming traffic at intersections to dangerous turnings off of busy roads. Sometimes accidents caused by poor road design will mean that the government or council will be liable.

Vehicle defects

Sometimes a road traffic accident will be caused by a defect in the driver's vehicle. These defects can be anything from brake failure to a tire bursting. Vehicle defects can cause an accident on the road, but sometimes these defects will cause more damage in an accident caused by something else. For example some cars will have defective airbags which do not deploy correctly, meaning people involved in accidents may suffer worse injuries. Also some SUV/people carrier style cars are prone to rolling easier which will result in worse injuries for the passengers.

Why Most AARTO Traffic Fines Issued Go Astray

The address to which thousands of AARTO traffic-fine notices issued each month are erroneously sent at public cost at a cost of over R3m in postage.

This outrageous statistic was emerged from a recent metro police chiefs' report. The documented flaws in the new Aarto system, as well as the costs from Aarto who is the Administrative Adjudication of Road Traffic Offences (Aarto) Act is under the spotlight.

The new system, which includes a demerit point system that could ultimately cost serial road-regulation offenders of their needed driving licences, will be implemented countrywide in 2011.

Why Most AARTO Traffic Fines Issued Go Astray

The South African metro police chiefs say that the national eNaTIS system's address list is being used to send and post notices of traffic fines to all vehicle owners by registered post. It was reported at least 60% of these addresses are incorrect and that the fines issued go astray.

This report has been confirmed by the CEO MR, Ranthoko Rakgoale of the Road Traffic Management Corporation (RTMC), which administers Aarto. It is known that eNaTIS draws its database information from forms which first ask all motorists to provide residential and then secondly their postal addresses.

While completing the postal address field, many motorists will often write: "As above". This "address" is then electronically captured by eNaTIS. This is where it all goes wrong.

When traffic fine notices are generated by the enatis system, the database information in the postal address field is then copied to the traffic fine notice for the local Post Office to deliver by registered post. This is why the post goes astray.

As a result of this problem, and other regular administrative errors, up to about 60% of the notices are returned undelivered. Often the Post office is blamed for this error, but it clearly a adminastrative problem.

The Post Office branches are struggling to handle the volumes of strayed AARTO notices.

Sadly the motorist is not able to benefit from the 32 days notice grace period, where they can dispute fines with irregularities or get 50% discount on the fines, because they do not they even have a fine issued.

Most motorist only find out about the offence when they are stopped in a road block or search on line for unaccounted fines issued.

Traffic Anarchy Software - Will it Generate Free Traffic For You?

Traffic Anarchy Software is scheduled to be released on Monday August 23rd.

The claims made by Steven Lee Jones, the creator of this new traffic generation tool, may sound at first exaggerated, if not outrageous, but are they? The purpose of this article is to help you understand what is Traffic Anarchy all about and to answer the question "will it generate traffic for you?"

What is Traffic Anarchy Software?

Traffic Anarchy Software - Will it Generate Free Traffic For You?

In a nutshell - the Traffic Anarchy is an all-in-one suite that is designed to generate free web traffic almost on an autopilot. I have used the word "almost" in order to dispel the notion that the consumer will not have to do anything, but sit at home and have this software 'go' out there and generate traffic 24/7 for him or her. It would be nice, but that is not how it works.

Having tested the Traffic Anarchy Software myself for over 10 days now, here is what it is capable of:

• Submitting articles to various article directories

• Submitting press releases to a select press-release agencies

• Submitting your site's bookmarks to various social bookmarking sites

• Submitting RSS feeds to RSS Directories

You can look at the Traffic Anarchy Software as your super duper submitter and a huge time saver. However, for it to do its thing, you will have to 'feed' it first with the respective content. And if you want to see quality results, namely quality traffic, you will have to feed it with high quality content.

It may seem like a huge task at first, but in all fairness it is not and here is why: To accomplish all that I have described above for the first time, it took me no more than an hour. However, with each subsequent use, and as I got the hang of it, it became easier. Now I got the submission time down to 25 minutes.

The Traffic Anarchy, like any other software, will have to be installed on your computer. The installation guide is easy to follow; if you know how to download a file and unzip it you will be fine. The somewhat more challenging - but also fun - part begins after the installation.

Before using Traffic Anarchy for the first time, you will have to create a separate account for each article directory, press release agency and social bookmarking site. That task, however, you do only once.

How does Traffic Anarchy Software Generate Free Traffic?

By submitting your fresh content in the form of press releases, articles, bookmarking and RSS feeds on a constant basis, your site will, inevitably, attract to it the attention of the search engines. The real "Anarchy," or, to use a better term, the real influx in traffic occurs when your site climbs to the first page of the search engines. That is how the Software will generate free traffic for you.

Please note: you would do yourself a huge disservice if you try to use this tool to post duplicate and/or poor quality content. In fact - you will be tarnishing your site's reputation, wasting your time and energy, let alone the money spent for the software.

In conclusion - the Traffic Anarchy Software is a powerful traffic generation tool and a huge time saver. Used properly it will most certainly generate all the free traffic that you want. The more often you use it and the higher the quality of the content submitted, the more targeted, free, traffic you will be attracting to your site.
